AffirmTrail is self-service documentation software based on user-supplied answers. It is not legal advice, not a C3PAO assessment, and not consulting. AffirmTrail never submits assessments or affirmations to SPRS on your behalf. Your Affirming Official remains solely responsible for the accuracy of any SPRS entry under applicable law, including the False Claims Act. TRNSFRM is a separate Cleveland and Columbus, Ohio cybersecurity and compliance partner (https://trnsfrm.tech).
Affirmation is a company representation, not an administrative click
Under 32 CFR 170.22, the Affirming Official must have authority to represent the organization. The affirmation concerns continuing compliance with the assessed requirements. It is not a guarantee created by buying a compliance tool, hiring a provider or completing a questionnaire.
Give the official a short review package: scope, status date, assessment result, open gaps, evidence index, changes since assessment and the responsible control owners. Resolve contradictions before the official affirms. If the SSP describes one environment while the evidence comes from another, the documentation is not ready merely because every checkbox is green.
PIEE and SPRS access must match the actual responsibility
PIEE provides the access path to SPRS. Follow current SPRS registration and role instructions for your organization and CAGE relationship. Do not share credentials or let a supplier representative use an executive’s login. Confirm the appropriate permissions with your account administrator and current official training materials.
Separate the preparer from the authorized official where feasible. Staff can collect evidence and prepare the binder, while the official reviews and makes the company’s representation. Keep the account approval, internal designation and dated review record with the assessment package.
Annual affirmation and assessment dates are distinct
An affirmation is required after an assessment, including applicable POA&M closeout, and annually thereafter. The assessment cadence and status validity depend on the level and assessment type. A Level 2 three-year assessment cycle does not eliminate annual affirmation.
Record the assessment date, CMMC Status Date, last affirmation and next affirmation due separately. The vault’s 60/30/7-day badges are calendar indicators, not delivered reminders or evidence that an affirmation happened. Establish an internal owner and independent reminder process for the official deadline.
Six-year artifact retention uses the status date
Assessment artifact retention is addressed in 170.15, 170.16 and 170.17, while 170.22 addresses affirmation. Retain supporting assessment evidence for six years from the CMMC Status Date. Annual affirmation does not automatically restart that retention clock. Certification-assessment artifact hashing and retention requirements must also be observed where applicable.
Retain more than an exported checklist: dated approvals, settings evidence, operating records, assessment findings and the scope that explains what was examined. Evidence references should point to a controlled internal repository. Plan for personnel turnover, provider transitions and the ability to retrieve records after a dispute, not just after the next audit.
Civil Cyber-Fraud Initiative and False Claims Act stakes
The Department of Justice Civil Cyber-Fraud Initiative uses the False Claims Act to address certain knowing misrepresentations concerning cybersecurity obligations. Potential exposure depends on facts and legal standards, not simply on whether a control fails. Do not treat this guide as legal advice about a particular claim.
An honest gap register, documented remediation and timely escalation are better than presenting an unsupported all-MET package. Have counsel review material uncertainties when contractual representations are at stake. AffirmTrail is self-service documentation software, not legal advice, not a C3PAO, and never submits an assessment or affirmation to SPRS for you.
